 PROPERTY TAX SALE BY TENDER – VARIOUS LOTS

Notice is hereby given, in accordance with the Municipal Government Act, Part 6, the Municipality of the District of Yarmouth is inviting sealed tenders for the following properties:

Directions:

Tenders shall be submitted in a sealed envelope, addressed to the undersigned and shall be clearly marked on the outside of the envelope “TENDER: LAND TO BE SOLD FOR TAXES”. Bidders shall complete the “Tender Form” for each property they wish to bid upon. The Tender Form is available at the Administration Office, Lower Level  at the Municipality of Yarmouth, by telephone (902)-742-7159 or by email This email address is being protected from spambots. Tenders will be accepted until 1:00 pm on Tuesday, July 15, 2025.

 

Terms: No minimum bids have been set, bid price excludes HST. The accepted tender price must be paid within three business days after being notified of acceptance. Failure to pay the accepted tender price within three business days will result in the land again being advertised and put up for sale. In addition to the bid, the bidder must pay the cost to cover preparation and registration of the Certificate of Sale and Tax Deed, approximately $500.00. The Municipality of the District of Yarmouth will accept cash, money order, debit, certified cheque or a lawyer’s trust cheque.

FAXED AND OR ELECTRONICALLY SUBMITTED TENDERS ARE NOT ACCEPTABLE AND WILL NOT BE CONSIDERED.

Property will be sold “as is where is”.

THE PROPERTIES OFFERED FOR TENDER ARE HST TAXABLE

It is also important to note that under the Municipal Government Act, Section 152, the right of redemption for properties sold at tax sale exists only up to six months after the sale.

Take Notice that tax sales do not in all circumstances clear up defects in titles. A tax deed conveys only the interest of the assessed owner, whatever that interest may be. All parties are advised to obtain legal advice on this matter.

Although the Municipality of the District of Yarmouth has made all reasonable efforts to confirm ownership, it does not guarantee title or boundaries of the aforementioned property. Prospective purchasers are responsible to conduct their own searches and surveys or other investigations. The Municipality of the District of Yarmouth makes no representations or warranties to any purchaser regarding the fitness, geophysical or environmental suitability of the land(s) offered for sale for any particular use and are being sold on a “as is” basis only.

 

The Municipality reserves the right to reject any or all tenders, not necessarily accept the highest tender, or to accept any tender which it may consider to be in its best interest. The Municipality also reserves the right to waive formality, informality or technicality in any tender.

 

Tender Opening:
Tenders will be awarded, notice given and the successful bidder will have until Monday, July 21 at 4:30pm to pay in full.

This property is subject to an Order of the Supreme Court of Nova Scotia issued February 14, 2024, in proceeding Yar No. 517591, requiring that the existing structure on the property must be removed and destroyed at the owner's expense. No occupancy of the structure is permitted without a valid occupancy permit. The Municipality makes no representations or warranties as to the condition of the structure or the ability to obtain permits for the property. Any purchaser will take title subject to the obligations and restrictions of the Court Order and assumes all risk and liability associated with the property, including potential demolition. It is the responsibility of the bidder to conduct their own due diligence. A copy of the Court Order may be obtained upon request from the Municipality.
